The Central District Court of Tyumen granted the request of the prosecutor, who requested the annulment of the marriage of a married couple due to the fact that one of the spouses changed the gender marker in the passport.

How explain RIA Novosti lawyer Pavel Rusnakov, who represented the interests of a married couple, it was in September 2022 that the registry office changed the gender marker in the passport.
In January 2023, the prosecutor address in court with a request in which he asked that the marriage be declared invalid “due to the change of sex of one of the married persons”. The lawsuit said that “a 33-year-old man filed a request to change his full name and gender from male to female,” and the registry office granted that request. The prosecutor filed a lawsuit, guided by the fact that according to the Family Code of the Russian Federation, marriage is “the union of a man and a woman.”
The court decided on the request after a debate in which representatives of the prosecutor’s office and the registry office participated, and lawyer Pavel Rusnakov represented the defendants. Rusnakov said in a conversation with Ura.ru that this is the first such court decision in Russia.

The couple’s attorney said he was unsure whether he would appeal the court’s decision yet, as he had to speak with the principals and study the text of the ruling.
